Trust Tax Returns

Trust returns, distributions and trustee resolutions handled carefully — because with trusts, the paperwork and timing really matter.

Overview

How we can help

Family and discretionary trusts can be effective structures, but they come with strict requirements. Distributions need to be decided correctly and on time, and each beneficiary's share must be reported accurately.

We prepare the trust accounts and return, help trustees prepare distribution resolutions before 30 June, issue beneficiary statements and coordinate beneficiaries' returns.

Good to Know

Key things to know

Official sources

  1. 01

    Resolutions by 30 June

Trustees generally need to make beneficiaries presently entitled to trust income by 30 June. Missing this can result in the trustee being taxed at the highest rate.

  2. 02

    Reimbursement agreements

The ATO closely reviews arrangements where a beneficiary is entitled to income but someone else receives the benefit (section 100A). Distributions should reflect genuine arrangements.

  3. 03

    Follow the trust deed

What a trustee can do depends on the trust deed. Distributions and decisions need to be consistent with its terms.

FAQs

Common questions

General information only. Your circumstances may differ — contact us for advice specific to you.

Can a trust distribute to anyone in the family?

Only to beneficiaries permitted by the trust deed, and distributions need to be made correctly. Distributions to minors are generally taxed at higher rates.

What happens if the resolution isn't made in time?

The trustee may be assessed on the trust income at the highest marginal rate, depending on the deed. Planning before 30 June avoids this.

Do you set up new trusts?

Trust deeds are legal documents. We can explain the tax considerations and work with your lawyer or a deed provider.
